Security guard gets 10 years’ jail, caning for raping disabled woman

(Bernama pic) JOHOR BAHRU: A security guard was sentenced to 10 years in prison and five strokes of the rotan by the sessions court here today after pleading guilty to raping a disabled woman. Judge Madihah Zainol handed down the sentence to R Sivanesan, 39, and ordered him to undergo counselling throughout his imprisonment and to remain under police supervision after serving his sentence. Sivanesan was charged with raping a 29-year-old woman whom he knew had hearing, speech and learning disabilities in Skudai, Iskandar Puteri, at 11.50pm on Jan 30. The charge was brought under Section 376(2)(K) of the Penal Code which provides for imprisonment of between 10 and 30 years and a caning, upon conviction. Deputy public prosecutor Nor Fadilah Johanuddin asked the court to impose a proportionate sentence on grounds that Sivanesan had taken advantage of a disabled victim. “In addition, the defence informed us that the accused is HIV-positive. The act put the victim at risk of contracting a sexually transmitted disease,” she said. Lawyer Omar Kutty Abdul Aziz, representing Sivanesan, appealed for a lighter sentence, saying his client had HIV and leukemia which required ongoing treatment. He also said that this was Sivanesan’s first offence.
