High Court acquits man of trafficking 43kg of cannabis

(File pic) PETALING JAYA: The Sungai Petani High Court today acquitted a man of two counts of trafficking about 43kg of cannabis found in a room at a house in Kota Kuala Muda, Kedah, seven years ago. Judicial commissioner Darmafikri Abu Adam acquitted Khairudin Abdullah, 53, without calling for his defence, after finding that the prosecution failed to adduce sufficient evidence to establish a prima facie case that he owned the seized drugs. Khairudin was accused of trafficking 24kg of cannabis under the first charge and 19kg under the second. He was accused of committing the offences in a room at a house in Kampung Permatang Pasir, Kota Kuala Muda, near Sungai Petani at about 11am on Sept 25, 2018. According to the facts of the case, a team of police officers arrived at the house at about 10.45am that day following a tip-off about drug trafficking activities. Police officer and prosecution witness Fairiz Nawi said the team observed the house for about 15 minutes and saw no movement in or out through the front door. Fairiz and a colleague then went to the side of the house and looked through an open window, where they saw Khairudin and his son watching television in the living room. Fairiz identified himself as a police officer and ordered Khairudin to open the door, after which the officers found the drugs in one of the rooms. Darmafikri said the prosecution failed to call witnesses such as his children and father, who lived nearby, to show that Khairudin had exclusive control and custody of the house and the drugs. The judge said two of Khairudin’s sons had records relating to drug abuse, and that it could be inferred that the drugs might have belonged to them. Lawyer Ali Munawar Razak represented Khairudin while deputy public prosecutor Nabila Huda Nazim appeared for the prosecution.
